Terms of Service

The terms that apply when you use PurpleMark products, websites, desktop applications, and related services.

Welcome to PurpleMark. These Terms of Service apply to PurpleMark desktop applications, websites, admin tools, APIs, technical support, and related features or services.

Please read these Terms before registering for, accessing, downloading, purchasing, installing, or using PurpleMark. By doing so, you acknowledge that you have read, understood, and agreed to these Terms.

1. Scope

These Terms govern the relationship between you and PurpleMark, meaning the PurpleMark brand and its operator, regarding access to and use of PurpleMark products and services.

PurpleMark may provide:

  • Browser profile management and isolation tools;
  • Proxy configuration and connectivity management;
  • Team workspace collaboration and access controls;
  • Account, login verification, and device session management;
  • Other related features expressly made available by PurpleMark.

2. Registration and Account Security

Certain features require an account and information such as an email address, verification code, and password. You must provide lawful, accurate, and current information.

You are responsible for protecting account credentials, verification codes, and authorized devices. You may not lend, sell, or transfer your account. Notify us through an official support channel if you discover unauthorized access or suspicious activity.

3. Service Description and Acceptable Use

PurpleMark provides software for browser profile management, proxy management, team collaboration, and related workflows. We may adjust features, interfaces, documentation, pricing, or access methods and may perform maintenance, upgrades, migrations, incident response, capacity changes, or security improvements when reasonably necessary.

You may use PurpleMark only for lawful, legitimate, and authorized purposes. You may not use it to:

  • Violate applicable law, regulation, or public policy;
  • Conduct fraud, phishing, spam, money laundering, gambling, or other unlawful activity;
  • Abuse platform resources, evade risk controls, bypass access restrictions, or circumvent third-party bans;
  • Access, collect, monitor, copy, control, or distribute accounts, data, or systems without authorization;
  • Transmit malware or other harmful code;
  • Reverse engineer, crack, interfere with, or bypass PurpleMark security, licensing, or product boundaries.

If we reasonably believe prohibited conduct has occurred, we may restrict features, suspend services, freeze accounts, retain relevant logs, cooperate with investigations, or terminate access.

4. Teams, Workspaces, and Devices

When using team workspaces, permissions, or device sessions, you must grant access only to authorized people, configure roles appropriately, and revoke access when roles change, cooperation ends, or devices are lost.

PurpleMark may apply reasonable security checks or limits to devices, request frequency, API use, and suspicious activity.

5. User Data and Content

You are responsible for account identifiers, browser profile configurations, proxy settings, team information, notes, tags, logs, and other data that you upload, configure, synchronize, store, or transmit. You represent that you have the necessary rights or authorization and that your use does not infringe third-party intellectual property, confidentiality, privacy, or other rights.

6. Intellectual Property

Intellectual property in PurpleMark software, code, interfaces, page designs, graphics, documents, logos, text, and trademarks belongs to PurpleMark or its licensors. Unless expressly permitted in writing, you may not copy, modify, distribute, lease, sell, sublicense, publicly display, or use these materials to develop a competing product.

7. Fees, Subscriptions, and Payments

Some services are paid. When you purchase a subscription, add-on, or enterprise plan, the applicable order, pricing page, checkout, invoice information, and supplemental terms also apply.

  • The price, included features, usage limits, and period shown at purchase apply to your order;
  • Unless checkout states otherwise, subscriptions may renew for the selected period until canceled before the next renewal date;
  • You may cancel future renewals using the receipt, subscription management link, or an official support channel;
  • Refunds are handled under our Refund Policy and applicable law;
  • When you use Paddle checkout, Paddle acts as merchant of record and handles payment, taxes, billing, and refund requests.

We may update pricing or packaging with reasonable notice through the product, website, email, or another appropriate channel.

8. Interruptions and Disclaimer

We use commercially reasonable efforts to maintain service continuity and security. Maintenance, infrastructure failures, third-party service issues, cyberattacks, your devices or configurations, and legal or regulatory requirements may cause interruptions, delays, restrictions, or unavailable data.

To the fullest extent permitted by law, PurpleMark is not liable for indirect, incidental, special, consequential, lost-profit, business interruption, data loss, or reputational damages arising from such events, except where caused by willful misconduct or gross negligence.

9. Changes, Suspension, and Termination

We may update these Terms for product, legal, compliance, or operational reasons and will publish changes through a reasonable channel. If you do not agree, you must stop using PurpleMark. Continued use after an update takes effect constitutes acceptance.

We may suspend or terminate all or part of the service if you violate these Terms, applicable law, or product rules.

10. Governing Law and Disputes

These Terms are governed by laws applicable where the PurpleMark operator is located, unless mandatory law requires otherwise. Disputes should first be addressed through good-faith negotiation. If unresolved, either party may seek relief from a court of competent jurisdiction or another mutually agreed dispute process.
