The terms that apply when you use PurpleMark products, websites, desktop applications, and related services.

Welcome to PurpleMark. These Terms of Service apply to PurpleMark desktop applications, websites, admin tools, APIs, technical support, and related features or services that we may provide from time to time.

Please read these Terms carefully before you register for, access, download, install, or use PurpleMark. By completing registration, checking the consent box, logging in, downloading, installing, or using PurpleMark, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Scope

These Terms govern the legal relationship between you and the PurpleMark operator regarding your access to and use of PurpleMark products and services.

PurpleMark may provide, among other things:

  • Browser environment management and isolation tools
  • Proxy configuration and connectivity management
  • Team workspace collaboration and access control
  • Account, login verification, and device session management
  • Other related features expressly made available by PurpleMark

2. Registration and Account Security

To use certain features, you may be required to register a PurpleMark account and provide necessary information such as your email address, verification code, and password. You must ensure that the information you provide is lawful, accurate, and up to date.

You are responsible for safeguarding your account credentials, verification codes, login devices, and related access methods. You may not lend, sell, transfer, or otherwise make your account available to any third party without authorization.

If you become aware of unauthorized access, suspicious activity, or any other security issue involving your account, you should notify PurpleMark promptly.

3. Service Description and Acceptable Use

PurpleMark provides software tools for browser environment management, proxy management, team collaboration, and related technical workflows. You understand and agree that:

  • PurpleMark may adjust features, interfaces, documentation, pricing, or service models based on product planning, technical conditions, compliance requirements, or operational needs.
  • PurpleMark may perform maintenance, upgrades, migrations, incident handling, risk controls, capacity adjustments, or security improvements when reasonably necessary.
  • Some features may vary depending on region, device environment, network conditions, third-party dependencies, subscription plans, or staged rollouts.

You may use PurpleMark only for lawful and legitimate purposes, including account isolation, testing, debugging, collaboration, privacy management, and authorized data handling. You may not use PurpleMark to:

  • Violate applicable laws, regulations, or public policy
  • Conduct fraud, phishing, spam distribution, money laundering, gambling, or other unlawful activity
  • Circumvent risk controls, bypass access restrictions, evade third-party bans, or abuse platform resources at scale
  • Access, collect, monitor, copy, control, or distribute accounts, data, or systems without authorization
  • Transmit malware, ransomware, trojans, worms, or other harmful code
  • Reverse engineer, decompile, disassemble, crack, interfere with, disable, or attempt to bypass PurpleMark security, licensing, or product boundaries

If PurpleMark reasonably believes that you have engaged in any prohibited conduct, PurpleMark may restrict features, suspend services, freeze accounts, retain logs, cooperate with investigations, or terminate access as appropriate.

4. Teams, Workspaces, and Device Use

If you use team workspaces, collaboration features, permissions, or device session capabilities, you are responsible for ensuring that:

  • Only authorized users are granted access
  • Roles and permissions are configured appropriately
  • Proxy credentials, environment data, session data, and team information are not shared without permission
  • Access is revoked promptly when members leave, roles change, devices are lost, or cooperation ends

PurpleMark may apply reasonable security limits to login devices, request frequency, API usage, or suspicious activity.

5. User Data and Content

You are solely responsible for any content, configuration, metadata, notes, tags, proxy settings, browser environment data, or other materials that you upload, sync, store, configure, or transmit through PurpleMark.

You represent and warrant that you have all necessary rights or authorizations to use such materials and that your use of PurpleMark will not infringe the rights of any third party, including intellectual property rights, trade secrets, privacy rights, or personal information rights.

To the maximum extent permitted by law, PurpleMark is not responsible for the legality, accuracy, integrity, authenticity, or consequences of data that you import, configure, or distribute through the service.

6. Intellectual Property

All intellectual property rights in PurpleMark products and services, including software, code, interfaces, page designs, graphics, documents, logos, text, and trademarks, belong to PurpleMark or its licensors.

Except as expressly permitted in writing, you may not copy, modify, distribute, lease, sell, sublicense, publicly display, or use PurpleMark materials to develop competing products. These Terms do not transfer any PurpleMark intellectual property rights to you.

7. Fees and Commercial Terms

Some PurpleMark features may be provided on a paid basis. If you purchase subscriptions, add-on services, enterprise plans, or other commercial offerings, the relevant order forms, checkout pages, invoices, or supplemental agreements will also apply.

PurpleMark may update pricing, packaging, usage limits, or commercial terms with reasonable notice through the product, website, email, or other appropriate channels.

8. Service Interruptions and Disclaimer

PurpleMark will use commercially reasonable efforts to maintain the continuity and security of its services. However, interruptions, delays, restrictions, or data unavailability may occur due to:

  • Maintenance, upgrades, migrations, backups, or incident response
  • Network issues, carrier failures, infrastructure outages, or power interruptions
  • Cyberattacks, malware, abuse, or other security events
  • Issues caused by your device, system, browser environment, proxy configuration, network conditions, or misuse
  • Legal, regulatory, judicial, or administrative requirements

To the fullest extent permitted by law, PurpleMark will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from such events, except where caused by PurpleMark's willful misconduct or gross negligence.

9. Changes, Suspension, and Termination

PurpleMark may revise these Terms based on product updates, legal changes, compliance requirements, or operational needs. Updated Terms will become effective upon publication or on the stated effective date.

If you do not agree to the updated Terms, you must stop using PurpleMark. Continued use after an update takes effect constitutes your acceptance of the revised Terms.

PurpleMark may suspend or terminate all or part of the service if you violate these Terms, applicable laws, or other product rules.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in the jurisdiction of the PurpleMark operator, unless otherwise required by law. Any dispute arising out of or relating to these Terms should first be resolved through good-faith negotiation. If no resolution is reached, either party may seek relief before a court of competent jurisdiction or use another dispute mechanism agreed by the parties.
